Evictions

On August 3, 2021, the CDC issued a new order “temporarily halting evictions in counties with heightened levels of community transmission in order to respond to recent, unexpected developments in the trajectory of the COVID-19 pandemic, including the rise of the Delta variant.” While this Order does not prevent landlords from filing eviction notices against tenants, it allows tenants the ability to argue for an extension for areas with high rates of Covid-19.

Foreclosures

On August 6, 2021, Chief Judge Barbera issued an amended Order to a previous order regarding evictions and foreclosures. This order requires that in all actions to foreclose a lien on a residential property and in all actions to foreclose the right of redemption of a residential property after a tax sale that was initiated or pending during the emergency period, any party seeking to advance such an action on the basis that it is not then subject to a federal or state stay, moratorium, or forbearance shall file a Declaration of Exemption from Moratorium setting forth certain required verified facts.  Additionally, this Order requires that landlord file a Declaration of Compliance with the CARES Act with any complaint for failure to pay rent.

Mask Mandate

Chief Barbera issued a new order that requires masks to be worn by all (except children aged 2 and under), regardless of vaccination status, in state courthouses and judicial facilities located in any Maryland county, or Baltimore City, where there is a COVID-19 community transmission rating by the CDC of “substantial” or “high” on any day after August 6, 2021.
